These Terms & Conditions ("Terms") govern your use of flare.link, the Flare desktop application, and related services (the "Service"). By creating an account, downloading the app, or using the Service, you agree to these Terms.
1. Who we are
The Service is operated by Flare ApS (CVR: 45446840), Elmegade 6A, 2200 København N, Denmark ("Flare", "we", "us"). Contact: [email protected].
2. Eligibility and accounts
You must be at least 13 years old to use the Service. You must provide accurate information, keep your account secure, and are responsible for activity under your account.
3. The Service
Flare provides tools to record, edit, upload, and host videos, generate share links, embed videos, and view analytics. We may change or discontinue features over time.
4. Plans, billing, and no refunds
Flare offers monthly and yearly subscriptions. Subscriptions renew automatically unless canceled before the renewal date.
- Fees are non-refundable except where required by law.
- Payment processing is handled by Mollie and their terms may apply.
- Taxes may be added based on your location and applicable law.
5. Storage and bandwidth fair use
Your plan includes up to 200 GB of stored content per user/account unless you upgrade or we agree otherwise in writing.
We apply fair use limits to protect the Service and other users. If your usage is excessive or abusive (for example, unusually high bandwidth usage or automated traffic), we may throttle uploads, processing, playback, or sharing, require an upgrade, or suspend access. We will generally provide notice where reasonably possible.
6. Public-by-default content and link risk
Videos are public by default, meaning anyone with the link can view them. We do not intend for public videos to be indexed by search engines.
Link secrecy is not a security guarantee. Even if a video is not indexed, it may still be discovered if the link is forwarded, embedded, shared publicly, or appears in logs/history. Because video URLs contain identifiers, it is theoretically possible for a third party to discover a video by guessing identifiers or using automated requests. We design identifiers to be difficult to guess and apply protective measures, but we cannot guarantee a public link will remain private.
If you do not want a video accessible to anyone with the link, you must use the privacy controls we provide (such as password protection) and are responsible for selecting and safeguarding passwords.
7. Acceptable use
- Do not violate laws or regulations.
- Do not upload content you do not have rights or consent to share.
- Do not attempt to disrupt or gain unauthorized access to the Service.
- Do not distribute malware or engage in abuse, harassment, hate, or threats.
- Illegal content (including CSAM) is prohibited and will be reported.
8. Your content and licenses
You retain ownership of your content ("User Content"). You grant Flare a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display your User Content solely to provide, maintain, and improve the Service.
You represent that you have all rights and permissions required to upload and share your User Content.
9. Copyright complaints
If you believe content hosted on Flare infringes your copyright, contact us at [email protected] with the work claimed to be infringed, the URL/link, your contact details, a good-faith statement, and your signature (electronic is acceptable). We may remove content and terminate repeat infringers.
10. Desktop app license
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App for personal or internal business use. You may not reverse engineer or bypass technical limitations except where prohibited by law.
11. Disclaimers
The Service is provided "as is" and "as available." We do not guarantee uninterrupted operation or error-free performance.
12. Limitation of liability
To the maximum extent permitted by law, Flare is not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits or data. Flare's total liability for any claim relating to the Service will not exceed the amount you paid Flare in the 12 months before the event giving rise to the claim (or DKK 750 if you paid nothing).
13. Suspension, termination, and retention
You may cancel at any time; cancellation takes effect at the end of the billing period. We may suspend or terminate access for violations, legal compliance, security risks, or non-payment.
We may define and update retention periods for content, logs, backups, and inactive accounts. If a material change affects your stored content availability, we will provide at least 30 days' notice where reasonably possible.
14. Governing law
These Terms are governed by Danish law. Disputes will be brought before the courts of Copenhagen, Denmark, unless mandatory consumer protection rules require otherwise.
15. Changes to these Terms
We may update these Terms from time to time. If changes are material, we will provide notice through the Service or by other reasonable means. Continued use after the effective date means you accept the updated Terms.
